Zoku Athletics presta un servicio digital de entrenamiento y bienestar deportivo dirigido a personas adultas, accesible a través del Sitio Web y la App. Los Servicios incluyen, con carácter enunciativo y no limitativo: temporizadores y programaciones de entrenamiento (WOD), catálogo de benchmarks, registro de sesiones, métricas de actividad y rendimiento, feed social y de la «Tribu», sistema de clasificaciones («Rival Live»), campañas solidarias («Solidary Reps»), integraciones con servicios de terceros (Spotify, Health Connect) y atención al cliente mediante tickets de soporte.

Determinadas funcionalidades requieren la suscripción a un plan de pago («Pro» o «Elite»). El alta, las condiciones económicas, la renovación y la cancelación de las suscripciones se rigen por los Términos de Uso y por la información facilitada en el proceso de contratación.

El acceso a los Servicios es libre y gratuito, salvo en lo relativo al coste de la conexión a la red de telecomunicaciones soportado por la persona usuaria. El uso de funcionalidades reservadas a personas registradas o suscritas exige el alta de una cuenta y, en su caso, la contratación del plan correspondiente.

La persona usuaria se compromete a:

• Hacer un uso diligente, lícito y de buena fe de los Servicios, conforme al presente Aviso Legal, a los Términos de Uso y a las disposiciones legales aplicables.
• Proporcionar información veraz, exacta y actualizada en los formularios de registro, contratación y soporte, y mantener actualizados sus datos personales y bancarios.
• Custodiar las credenciales de acceso y notificar de forma inmediata cualquier uso no autorizado de la cuenta a través de los canales de soporte.
• Abstenerse de utilizar los Servicios con fines o efectos contrarios a la ley, a la moral, al orden público o lesivos para los derechos o intereses del Titular o de terceros.
• No introducir, almacenar ni difundir, mediante los Servicios, código malicioso, contenidos ilícitos, difamatorios, discriminatorios, violentos, pornográficos o contrarios a la dignidad de las personas.
• No realizar acciones que puedan dañar, sobrecargar, deteriorar o impedir la normal utilización de los Servicios, incluidas técnicas de scraping, ingeniería inversa o ataques automatizados.

Los Servicios están dirigidos a personas mayores de edad. No obstante, podrán registrarse personas mayores de 14 años conforme a la edad mínima de consentimiento prevista en el artículo 7 de la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD). El registro de menores de 14 años requiere el consentimiento expreso de la persona titular de la patria potestad o tutela. El Titular podrá solicitar acreditación adicional en caso de duda razonable sobre la edad declarada y, de no obtenerse, cancelar la cuenta.

Todos los contenidos del Sitio Web y de la App -incluyendo, de forma no limitativa, textos, fotografías, gráficos, imágenes, iconos, marcas, nombres comerciales, código fuente, diseño, estructura de navegación, bases de datos y demás elementos- son titularidad del Titular o, en su caso, de terceros que han autorizado su uso, y se encuentran protegidos por la normativa de propiedad intelectual e industrial.

La denominación «Zoku», «Zoku Athletics», el logotipo y los signos distintivos asociados son marcas y signos comerciales del Titular. Cualquier reproducción, distribución, comunicación pública, puesta a disposición, transformación o cualquier otra forma de explotación, total o parcial, requiere la autorización previa, expresa y por escrito del Titular o del legítimo titular de los derechos. Quedan prohibidas, en particular, las prácticas de framing, scraping, deep linking comercial o cualquier uso que pueda inducir a error sobre el origen o titularidad del contenido.

Los contenidos generados por las personas usuarias (textos, comentarios, kudos, imágenes de avatar, resultados publicados en el feed) seguirán siendo de su titularidad. No obstante, al publicarlos en los Servicios la persona usuaria concede al Titular una licencia mundial, no exclusiva, gratuita, sublicenciable y por el plazo máximo permitido por la ley para reproducirlos, comunicarlos públicamente y adaptarlos con la finalidad de prestar y promocionar los Servicios.

El Titular pondrá los medios razonables para garantizar la disponibilidad, continuidad y seguridad de los Servicios. No obstante, no puede garantizar la ausencia total de interrupciones, errores, virus u otros elementos lesivos que puedan producir alteraciones en los sistemas de la persona usuaria. El Titular queda exonerado de responsabilidad por los daños y perjuicios que pudieran derivarse de:

• Interrupciones del servicio, retrasos, errores o mal funcionamiento del Sitio Web o la App imputables a causas ajenas a su control razonable, incluidas las debidas a infraestructuras de terceros (proveedor de hosting, registrador de dominio, pasarelas de pago, servicios de notificaciones).
• Decisiones adoptadas por las personas usuarias sobre la base de la información ofrecida en los Servicios, especialmente en lo relativo a la planificación de entrenamientos, intensidades y volúmenes de carga.
• Uso indebido, ilícito o negligente de los Servicios por terceros, incluido el acceso no autorizado a la cuenta cuando sea consecuencia de la pérdida o cesión de credenciales por la persona usuaria.
• Contenidos publicados por terceros, incluidas las personas usuarias del feed social, que serán de su exclusiva responsabilidad.

El Sitio Web y la App pueden incluir enlaces o integraciones con páginas y servicios prestados por terceros, en particular Spotify (reproducción musical y autenticación OAuth), Health Connect (datos de actividad y salud), Stripe (procesamiento de pagos), Google y Supabase (autenticación y almacenamiento). El Titular no comercializa, controla ni supervisa los contenidos, políticas o prácticas de dichos terceros y declina toda responsabilidad sobre los mismos. El acceso a estos servicios se rige por las condiciones y políticas de privacidad de sus respectivos proveedores, cuya lectura se recomienda antes de su uso.

El Titular se reserva el derecho a modificar, en cualquier momento y sin previo aviso, el presente Aviso Legal, así como la presentación, configuración y contenidos de los Servicios. La continuidad en el uso de los Servicios tras la publicación de una modificación implica la aceptación de la nueva versión.

El presente Aviso Legal se rige por la legislación española. Zoku Athletics provides a digital training and sports wellness service aimed at adults, accessible through the Website and the App. The Services include, without limitation: workout timers and training schedules (WOD), a catalog of benchmarks, session logging, activity and performance metrics, a social and "Tribe" feed, a ranking system ("Rival Live"), charitable campaigns ("Solidary Reps"), integrations with third-party services (Spotify, Health Connect) and customer support via support tickets.

Certain features require a paid subscription ("Pro" or "Elite"). Subscription enrollment, pricing, renewal and cancellation are governed by the Terms of Use and by the information provided during the purchase process.

Access to the Services is free and open, except for the cost of telecommunications network access borne by the user. Use of features reserved for registered or subscribed users requires the creation of an account and, where applicable, the contracting of the relevant plan.

The user undertakes to:

Content generated by users (texts, comments, kudos, avatar images, results published in the feed) shall remain their property. However, by publishing them in the Services, the user grants the Owner a worldwide, non-exclusive, royalty-free, sublicensable license, for the maximum term permitted by law, to reproduce, publicly communicate and adapt them for the purpose of providing and promoting the Services.

The Owner shall use reasonable means to ensure the availability, continuity and security of the Services. Nevertheless, it cannot guarantee the complete absence of interruptions, errors, viruses or other harmful elements that may alter the user's systems. The Owner is released from liability for damages that may arise from:

• Service interruptions, delays, errors or malfunctions of the Website or the App attributable to causes beyond its reasonable control, including those due to third-party infrastructure (hosting provider, domain registrar, payment gateways, notification services).
• Decisions made by users based on the information offered in the Services, especially regarding training planning, intensities and load volumes.

The Website and the App may include links or integrations with pages and services provided by third parties, in particular Spotify (music playback and OAuth authentication), Health Connect (activity and health data), Stripe (payment processing), Google and Supabase (authentication and storage). The Owner does not market, control or supervise the content, policies or practices of such third parties and disclaims any responsibility for them. Access to these services is governed by the conditions and privacy policies of their respective providers, which we recommend reading before use.

The Owner reserves the right to modify, at any time and without prior notice, this Legal Notice, as well as the presentation, configuration and content of the Services. Modifications shall take effect upon their publication on the Website. Periodic review of this page is recommended. Continued use of the Services after the publication of a modification implies acceptance of the new version.

This Legal Notice is governed by Spanish law.
